Terms of Service
Effective Date: April 7, 2026
PLEASE READ THESE TERMS CAREFULLY. They contain an agreement to arbitrate and class action waiver (Section 11). By creating an account, depositing funds, or entering any Tournament on ETERNEL, you agree to be bound by these Terms of Service, our Privacy Policy, our Cookie Policy, our Responsible Gaming Policy, and our Game Rules (collectively, the “Agreement”). If you do not agree, do not use the Platform.
Article 1 — Definitions
In these Terms, the following words have specific meanings:
- “Platform” means ETERNEL, accessible at eternelgames.com and through associated mobile and web applications, including all services, features, and content. The Platform intellectual property is owned by Eternel Games LLC. The Platform is operated by Eternel Games Ltd.
- “Operator” means Eternel Games LLC, a Wyoming limited liability company (“IP Entity”), and Eternel Games Ltd, a company registered in England and Wales (Company No. 17139657) with its registered office at 128 City Road, London, EC1V 2NX (“Operating Entity”), collectively referred to as “Eternel” or “the Operator.”
- “IP Entity” means Eternel Games LLC, the entity that owns and licenses all intellectual property associated with the Platform.
- “Operating Entity” means Eternel Games Ltd, the entity that operates the Platform, manages user accounts, processes transactions, and administers Tournaments.
- “User” or “Player” means any person who creates an account on the Platform.
- “Game” means any competitive multiplayer game offered on the Platform. The Platform currently offers Serpenta Battle Royale. Additional Games may be added in the future.
- “Tournament” means a single match in which 4–12 players compete for prizes based on their in-game performance and final placement.
- “Entry Fee” means the amount paid by a Player to join a Tournament, also referred to as a “buy-in.”
- “Tier” means a Tournament level with a specific Entry Fee: Free ($0), Silver ($1.00), Gold ($5.00), or Platinum ($10.00).
- “Rake” means the platform commission of 10% deducted from the total Entry Fees collected for a paid Tournament before prizes are distributed. The Free Tier has no Rake.
- “Prize Pool” means the total Entry Fees minus the Rake, distributed to the top 3 finishers: 1st place receives 50%, 2nd place receives 30%, and 3rd place receives 20%.
- “Wallet” means a withdrawal destination (crypto address or supported payment method) designated by the Player for approved withdrawals.
- “Balance” means the Player’s real-money account balance on the Platform, denominated in US Dollars.
- “Restricted Jurisdiction” means any state, territory, or country where paid tournament play on the Platform is prohibited or restricted by law, as further described in Article 8.
- “Game Rules” means the official rules for each Game published at eternelgames.com/games/[game-name]/rules, which are incorporated into this Agreement by reference.
Article 2 — Eligibility & Account
2.1 Age Requirement
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account, deposit funds, join paid Tournaments, or request withdrawals. Free, no-money practice gameplay may be used by users of any age where lawful.
2.2 Identity Verification (KYC)
Know Your Customer (KYC) verification is mandatory before any withdrawal is approved. The Operator may also require KYC before enabling or continuing paid gameplay access based on risk assessment. KYC requires: (a) a valid government-issued photo ID; and (b) proof of address (utility bill or bank statement dated within the last 3 months).
The Operator employs a risk-based approach and may request identity verification at any time based on factors including but not limited to: cumulative deposit thresholds, IP address and geolocation anomalies, country of residence, transaction patterns, and overall risk assessment. The Operator reserves the right to suspend deposit functionality or freeze account funds until KYC is satisfactorily completed.
2.3 One Account Per Person
Each person may hold only one account. Creating or operating multiple accounts (“multi-accounting”) is strictly prohibited and will result in permanent ban and forfeiture of all balances.
2.4 Account Security
Your account is personal and non-transferable. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify the Operator immediately if you suspect unauthorized access.
2.5 Account Suspension
The Operator reserves the right to suspend, restrict, or permanently terminate any account that violates these Terms, at its sole discretion and without prior notice where necessary to prevent fraud, abuse, or legal non-compliance.
Article 3 — Game Rules & Mechanics
3.1 Nature of the Platform
ETERNEL is a competitive multiplayer tournament platform. All games offered on the Platform are performance-based — outcomes are determined by player input and fixed game rules, not by random number generation (RNG). Each Game has its own published rules, available at eternelgames.com/games/[game-name]/rules.
3.2 Current Games
The Platform currently offers Serpenta Battle Royale, a real-time multiplayer snake tournament where 4–12 players compete in a shrinking arena. 3.3 Tiers & Entry Fees
Tournaments are organized into Tiers with fixed Entry Fees:

The Entry Fee is charged upon joining a Tournament lobby and is non-refundable once the game countdown begins. If a Tournament fails to start (e.g., server error), Entry Fees are refunded in full.
3.4 Rake (Platform Commission)
The Rake is 10% of the total Entry Fees collected for each paid Tournament. It is deducted from the total pot before prizes are distributed. The Free Tier has no Rake. The Rake amount is disclosed transparently in the lobby before the game begins.
3.5 Tournament Format
Tournaments use a fill-and-lock format for 4–12 players. Once the lobby reaches capacity, a 5-second countdown begins and no new players may join. The specific format, mechanics, and victory conditions vary by Game and are documented in each Game’s published Rules.
3.6 Prize Distribution
The Prize Pool (total Entry Fees minus 10% Rake) is distributed to the top 3 finishers:
- 1st Place: 50% of the Prize Pool
- 2nd Place: 30% of the Prize Pool
- 3rd Place: 20% of the Prize Pool
Prizes are credited instantly to the winners’ account balances upon game completion. Players finishing 4th–12th do not receive a prize and forfeit their Entry Fee.
3.7 Free Tier (Practice Mode)
The Free Tier involves no paid entry. It exists for practice purposes only. Players compete against bot opponents to learn game mechanics. Free practice mode is available to all users worldwide, including in Restricted Jurisdictions.
3.8 Game Parameter Changes
The Operator may adjust game parameters (including but not limited to Rake rates, player counts, zone behavior, and prize distribution) at any time. Material changes will be communicated via the Platform with at least 7 days’ notice before taking effect.
Article 4 — Deposits & Withdrawals
4.1 Deposits
Paid play uses your internal Platform Balance, denominated in USD. Funds may be deposited via supported methods including USDC on Solana, other supported cryptocurrencies (converted automatically), and supported fiat payment methods. Minimum deposit: $2.00.
Deposits are available to users worldwide, subject to KYC requirements and applicable sanctions/compliance checks. Deposited funds can only be used for Tournament Entry Fees on the Platform.
4.2 Withdrawals
Withdrawals are processed by the Operating Entity (Eternel Games Ltd) after manual review and approval. Minimum withdrawal: $10.00. Processing time: up to 5 business days after approval.
KYC verification must be completed before any withdrawal is approved. The Operator reserves the right to request additional verification for withdrawals exceeding $500 or in cases where suspicious activity is detected. See our AML & KYC Policy for full details.
4.3 Currency
All account balances and transactions are denominated in US Dollars ($).
4.4 Taxes
You are solely responsible for reporting and paying any taxes owed on your winnings in your jurisdiction. The Platform does not withhold taxes on your behalf. If required by applicable tax law, the Operator will issue tax forms (such as IRS Form 1099) to players who meet applicable reporting thresholds. See our Tax Information page for general guidance.
Article 5 — Prohibited Conduct
The following conduct is strictly prohibited on the Platform:
- Collusion or teaming — coordinating with other players in a Tournament to gain unfair advantage
- Multi-accounting — creating or using more than one account
- Automation — use of bots, scripts, macros, or any automation tools
- Bug exploitation — exploiting bugs, glitches, or unintended behavior (players must report these immediately)
- Feeding — intentionally losing or transferring value to another player
- Account trading — sharing, selling, or transferring accounts
- Financial crime — money laundering, fraud, or any use of the Platform for illegal financial activity
- Abuse — harassment, hate speech, threats, or abusive behavior toward other players or staff
- Tampering — attempting to reverse-engineer, decompile, hack, or disrupt the Platform or its infrastructure
- Location spoofing — using VPNs, proxy servers, GPS spoofing tools, or any other technology to circumvent geographic restrictions or misrepresent your location
- Underage play — accessing paid features while under the minimum age requirement
Penalties: Violations may result in, at the Operator’s sole discretion: a warning, temporary suspension, permanent ban, and/or forfeiture of account balance. The Operator may report suspected illegal activity to the appropriate authorities.
Article 6 — Anti-Teaming & Fair Play
The Platform uses automated behavioral detection systems to identify collusion and teaming. Detection methods include proximity analysis, movement pattern correlation, selective non-aggression tracking, and statistical anomaly detection.
Players flagged for teaming may receive in-game penalties or account sanctions. The Operator’s determination of collusion is final.
Players may appeal sanctions by contacting [email protected] with their account details and a description of the situation. Appeals will be reviewed within 5 business days.
Article 7 — Performance-Based Competition Classification
ETERNEL operates competitions in which outcomes are determined by player actions: real-time movement control, strategic positioning, boost timing, combat decisions, and zone management.
No random number generator (RNG) determines the outcome of any player-versus-player encounter. Specifically:
- Deterministic combat — collision outcomes are resolved by fixed rules based on speed, boost status, and size. No randomness is involved.
- Symmetric conditions — all players start with the same base stats. The shrinking zone and food spawns apply equally to all players.
- Complete information — all game state is visible to all players. There is no hidden information or asymmetric advantage.
- Skill-expressive mechanics — movement, boost management, spatial awareness, and strategic decision-making are the determining factors in every outcome.
This classification is intended to align with legal standards commonly applied to performance-based competitions under both the “dominant factor” test and the more restrictive “material element” test in various US jurisdictions. Article 8 — Geographic Eligibility & Geo-Fencing
8.1 Global Access
The Platform is accessible to users worldwide. Any person may create an account, access the Platform, and play in the Free Tier (practice mode) from any location.
8.2 Paid Tournament Restrictions
To enter paid Tournaments (Silver, Gold, or Platinum tiers), you must be physically located in a jurisdiction where those competitions are legal at the time of entry. The Platform uses real-time geo-fencing technology — including GPS data, IP address geolocation, and device-level location services — to verify your physical location before allowing entry into any paid Tournament.
8.3 Restricted US Jurisdictions
Paid Tournaments are currently not available in the following US states and territories:
Arizona, Arkansas, Connecticut, Delaware, Florida, Kentucky, Louisiana, Maine, Michigan, Mississippi, Montana, South Carolina, South Dakota, Tennessee, and Washington D.C.
This list is subject to change as laws evolve. The Operator continuously monitors legislative and regulatory developments and updates geographic restrictions accordingly.
8.4 International Users
Users outside the United States may participate in paid Tournaments provided that those competitions are legal in their jurisdiction. It is the Player’s sole responsibility to verify that their use of the Platform complies with all applicable local laws and regulations.
8.5 VPN and Location Spoofing Prohibition
The use of VPNs, proxy servers, GPS spoofing tools, or any other technology to circumvent geographic restrictions is strictly prohibited and constitutes a violation of these Terms. The Platform actively detects and blocks such tools. Violations will result in immediate account suspension and potential forfeiture of funds.
8.6 Deposits and Withdrawals
Deposits may be made from any location worldwide, subject to KYC requirements and applicable sanctions/compliance checks. Withdrawals may be requested from any location. However, paid Tournament entry is restricted by real-time geo-fencing as described above.
Article 9 — Responsible Gaming
The Platform is committed to promoting responsible gaming. The following tools are available to all Players:
- Deposit limits — daily, weekly, or monthly, self-set by the Player
- Session reminders — periodic notifications of play duration
- Cool-off periods — 24-hour, 48-hour, or 7-day temporary self-exclusion from paid Tournaments
- Self-exclusion — temporary (7, 30, or 90 days) or permanent
- Transaction history — full history of all Entry Fees, prizes, deposits, and withdrawals, accessible at all times
If the Operator suspects problematic gaming behavior, it may contact the Player, impose limits, or suspend the account.
Minors: Users under 18 (or the age of majority in their jurisdiction) may access only free/no-money practice gameplay. Any minor attempting to access paid features will be blocked.

Article 10 — Intellectual Property
All game content, code, graphics, sounds, trade names, trademarks, and branding are owned by Eternel Games LLC or its licensors. The ETERNEL name, logo, and brand are trademarks of the Operator. All rights not expressly granted herein are reserved.
Player-generated content (such as usernames and display names) grants the Platform a worldwide, non-exclusive, royalty-free license to display that content within the service. Players may not copy, redistribute, modify, or commercially exploit any Platform content without prior written consent from the Operator.
Article 11 — Dispute Resolution & Arbitration
11.1 Informal Resolution
Players should first contact support at [email protected]. The Operator will respond within 48 hours and will attempt to resolve any dispute informally within 30 days.
11.2 Governing Law — US Users
If you are located in the United States, these Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Disputes that cannot be resolved informally shall be submitted to binding arbitration administered by the International Chamber of Commerce (ICC) in accordance with ICC Rules of Arbitration. The arbitration shall be conducted by a single arbitrator. The seat of arbitration shall be Cheyenne, Wyoming, United States. The language of arbitration shall be English. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.
11.3 Governing Law — Non-US Users
If you are located outside the United States, these Terms are governed by the laws of England and Wales. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11.4 Class Action Waiver (US Users)
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against the Operator.
11.5 Opt-Out (US Users)
You may opt out of the arbitration agreement by sending written notice to [email protected] within 30 days of creating your account. The notice must include your full name, account email, and a clear statement that you wish to opt out of binding arbitration.
Article 12 — Disclaimers & Limitation of Liability
The Platform is provided “AS IS” and “AS AVAILABLE.” The Operator makes no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Operator is not responsible for losses resulting from: internet connectivity issues, device failures, server outages, force majeure events, or any other circumstances beyond its reasonable control.
Server interruptions: In the event of a server failure during an active Tournament, the Operator will attempt to restore game state. If restoration is not possible, Entry Fees for affected sessions will be refunded in full.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the Operator’s total aggregate liability arising out of or relating to these Terms or your use of the Platform shall not exceed the greater of (a) the Player’s account balance at the time of the incident, or (b) $100.
The Operator is not responsible for losses from normal gameplay — losing Tournaments is an inherent part of competitive gaming. ETERNEL is entertainment, not a financial product, investment, or gambling service.
Article 13 — Modifications to These Terms
The Operator may update these Terms at any time. Material changes will be communicated via email and/or in-app notification at least 14 days before taking effect.
Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. Players who disagree may close their account and withdraw their balance at any time before the changes take effect.
Article 14 — Termination
Players may close their account at any time by contacting support. Upon closure, players may withdraw their remaining balance subject to minimum withdrawal requirements, completed KYC, and standard withdrawal processing.
The Operator may terminate accounts for violation of these Terms. Upon termination for cause, the Operator may forfeit remaining balance if the violation involves fraud, collusion, money laundering, or other prohibited conduct under Article 5.
Article 15 — Miscellaneous
- Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions continue in full force and effect.
- Entire agreement: These Terms, together with the Privacy Policy, Cookie Policy, Responsible Gaming Policy, AML & KYC Policy, and applicable Game Rules, constitute the entire agreement between you and the Operator regarding use of the Platform.
- No waiver: The Operator’s failure to enforce any provision of these Terms does not constitute a waiver of that provision or the right to enforce it later.
- Assignment: The Operator may assign its rights and obligations under these Terms without notice. Players may not assign their accounts or any rights under these Terms.
- Force majeure: The Operator shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including natural disasters, war, terrorism, pandemic, government actions, or internet service disruptions.
- Language: In the event of a conflict between translated versions and the English version of these Terms, the English version prevails.
